Magazine Subscription Settlement Notes

  • Kyle Sullivan and Jeanne Sloan v. Wenner Media LLC
  • Case No.1:16-CV-00960
  • Pending in the U.S. District Court for the Eastern District of Michigan

Plaintiffs Kyle Sullivan and Jeanne Sloan filed the class action lawsuit against Wenner Media, the publisher of several magazines including Rolling Stone, Men’s Journal, and Us Weekly, alleging the company violated Michigan’s Video Rental Privacy Act (which includes magazine subscriptions) by disclosing information related to its customers’ magazine subscriptions to third parties – all without informing its customers or obtaining their consent to do so.

Specifically, the plaintiffs and other class members claim that after they subscribed to Wenner Media’s publications, their right to privacy was violated when Wenner sold its customers’ personal information, including, but not limited to, their name, address and subscription history, to anyone willing to buy that information.

Wenner Media maintains that it complied with the law and does not admit any wrongdoing. Complete details about the case and settlement are provided on the Rolling Stones, Men’s Journal, & US Weekly Magazine Subscription Settlement website.

A similar magazine subscriber privacy class action lawsuit against Trusted Media Brands, the publisher of magazines such as the Reader’s Digest was recently settled for $8.2 million. That lawsuit also alleged violation of Michigan’s VPRA and privacy statutes with class members claiming they were barraged with telemarketing calls, junk mail, and spam emails after their information was sold to third parties by TMB without their consent.

Class members who wish to exclude themselves or object to the terms of the Wenner Media Magazine Subscription Settlement must do so by March 5, 2018. Class members who wish to participate in the settlement must submit their claim form on or before March 5, 2018.
