Class members of the Hustler Hollywood FACTA Credit Card Receipt Settlement include “all persons within the United States who (1) used a credit or debit card; (2) for a transaction at one of Defendant’s retail locations; and (3) were provided a point of sale receipt that displayed more than the last 5 digits of the card’s account number and/or the expiration date of the card; (4) from April 18, 2015 through February 26, 2018.”

Plaintiff Wade Glenn Witworth filed this class action lawsuit alleging Hustler Hollywood violated the Fair and Accurate Credit Transactions Act by printing full credit card expiration dates and not truncating his credit number on customer purchase receipts.

Passed in 2003, FACTA is a law that protects consumers from having their credit or debit card information printed on their purchase receipts. The FTC gives an example of what a compliant FACTA credit or debit card receipt should look like:

Class members whoo submit a valid and timely claim form are  entitled to one TSP Gift Card in an amount of $100.00. Each TSP Gift Card shall be fully transferable to any and all other persons and shall not expire. The TSP Gift Cards are not redeemable for cash and may only be used to make the purchase of goods or services from any TSP location.

Tacoma Screw Products FACTA Receipt Settlement Notes

In July 2016, plaintiff Albert Viesse alleged that Tacoma Screw Products willfully violated the Fair and Accurate Credit Transactions Act (FACTA) by printing the expiration date of his and other consumers’ credit credit and/or debit cards on their electronically printed customer receipts on and after July 1, 2014.

According to FACTA law, businesses are required to shorten – or truncate – customer account information in order to protect against identity theft. Retailers and merchants many not include more than than the lst five digits of a customer’s credit or debit card number, and must not print the card’s expiration date. The FTC provides an example of what a FACTA compliant receipt that truncates the credit card number and deletes the expiration date should look like:

Tacoma Screw Products does not admit any violation of FACTA by agreeing to the proposed settlement.

Under the terms of the Tacoma Screw Products FACTA Receipt Settlement, the company will provide a TSP gift card in the amount of $100.00 to each Class member who submits a valid and timely claim form. These gift cards will not expire and can only be used to make purchases from any TSP stores. Additionally, Tacoma Screw Products has changed its point of sale (“POS”) system programming to comply with FACTA’s prohibition on displaying expiration dates on credit or debit card receipts and has implemented a FACTA compliance policy to ensure that it does not print credit or debit card receipts which display the expiration date or more than the last 5 digits of the card number.

Sea World FACTA Receipt Settlement Notes

Plaintiffs Christopher Diaz and Brendan Brown filed this class action lawsuit against Sea World in California Superior Court, alleging the theme park company violated the Fair and Accurate Credit Transactions Act (FACTA) by willfully printing the expiration date of customers’ credit and debit cards on receipts, including receipts for parking and admission.

In this day and age, identity theft is rampant and no one is immune. Therefore, it is imperative that you feel safe about using your credit card or debit card when making purchases. That’s why Congress enacted the Fair and Accurate Credit Transactions Act or FACTA. FACTA law prohibits businesses to print the expiration date of customers’ credit or debit cards on an electronically printed receipt. Additionally, the receipt must truncate the actual credit or debit card number on the receipt. This is to help prevent identity thieves from being able to piece together your personal information. Businesses that fail to comply with FACTA can face huge fines.

Sea World denies any liability and there has been no court ruling that Sea World has violated any laws. Under the terms of the Sea World FACTA receipt settlement, Sea World will pay either $25 cash to claimants who submit valid and timely claims, along with a copy of their receipt showing their expiration date or for claimants who do not have proof, Sea World will issue two $4.75 (total value $9.50) concession certificates. Note: These certificates are not gift cards and are not bound by gift card laws.

Saar’s Super Saver Foods FACTA Receipt Settlement Notes

In 2016, plaintiff Albert Viesse alleged that specific Washington state Saar’s and Super Saver Foods stores willfully violated the Fair and Accurate Credit Transactions Act (FACTA) by printing the expiration date of his and other consumers’ credit credit and/or debit cards on their electronically printed customer receipts.

FACTA was enacted into law as an amendment to the Fair Credit Reporting Act in an effort to protect consumers from identity theft. The law has vert specific requirements for the ways consumer information can be shared. One of these is that retailers and merchants must truncate customer payment receipts so that the customer’s full account number is not viewable on the receipt. FACTA also stipulates that the customer’s card expiration date cannot be printed on the receipt.

Saar’s does not admit any violation of FACTA by agreeing to the proposed settlement.

Under the terms of the Saar’s FACTA Settlement, Saar’s will provide a Saar’s gift card in an amount up to $75.00 to each Class member who submits a valid and timely claim form. Thise gift cards will not expire and can only be used to make purchases from any of the Saar’s stores. Additionally, Saar’s will implement a written policy which will state that it will not print more than the last fice digits of the credit or debit card number nor the credit or debit card expiration date on any printed customer receipt.
