Who is a Class Member

Class members of the 24 Hour Fitness Prepaid Membership Settlement include all U.S. residents “who enrolled in, or *updated a 24 Hour Fitness Prepaid Membership on or after April 1, 2006, and were still enrolled in a Prepaid Membership as of April 1, 2015, as indicated in 24 Hour Fitness’s membership records system.”

The 24 Hour Fitness Prepaid Membership settlement resolves claims in two consolidated class action lawsuits as well as a government lawsuit. These lawsuits allege that 24 Hour Fitness fraudulently induced customers into purchasing “lifetime memberships” to its gyms, where if they prepaid one to three years’ worth of membership fees, they were promised in exchange that they would only have to nominal annual renewal fees each year thereafter. These annual renewal fees were supposed to remain constant for the remainder of the member’s life – the Lifetime Fee Guarantee.

However, when 24 Hour Fitness came under new ownership, the gym chain decided to stop honoring the Lifetime Fee Guarantees and told members – some of whom had paid the same annual renewal fee for more than two decades – that their fees would increase. In most cases, these fees doubled or triples their previous rates.

When members voiced their outrage to this alleged breach of contract across the U.S., 24 Hour Fitness responded by telling members to look at the fine print on their membership agreements and argued that it is allowed to increase annual renewal fees as much as they want – regardless of what their sales representative promised.

This prompted plaintiffs Kevin O’Shea, Mark Vitcov, Rod Morris, Michael Losquadro, Russell Marchewka, and Dipti Shah to file a consolidated class action lawsuit, calling 24 Hour Fitness out on their alleged bait and switch prepaid membership scheme.

24 Hour Fitness denies these allegations and that it violated the law by increasing annual renewal amounts for prepaid members, but agreed to the settlement to end the lawsuit and avoid the uncertainties and costs associated with a trial. The settlement was preliminary approved on December 14, 2017.

Class members who wish to opt-out or object to the terms of the 24 Hour Fitness Prepaid Membership Settlement must do so by February 26, 2018. Class members who wish to submit a claim must do so by February 26, 2018.
