Who is a Class Member

  • RMG TCPA Settlement class members are defined as anyone in the United States who received a pre-recorded telemarketing call between July of 2009 and March of 2014 that were initiated by RMG during which they were offered a free cruise with Carnival, Royal Caribbean and Norwegian cruise lines and the phone number is contained in the call records produced by RMG in this case

Settlement Amount

  • According to the terms of the settlement class members can claim up to 3 calls at $300 a piece (which would be the class member could possibly receive up to $900)

Proof of Purchase

  • Class members must provide their phone number or claim number (the RMG TCPA Settlement claim number can be found on class notices mailed to class members)

A class action lawsuit has been filed against Carnival, Norwegian or Royal Caribbean claiming they violated the TCPA (Telephone Consumer Protection Act) when they made telemarketing phone calls without receiving the express written consent from the consumer.  These calls were in relation to promotional calls from RMG offering the goods and services of Carnival, Royal and Norwegian.

The defendants denied any actions of wrong doing in the case but have agreed to a settlement fund of $7,000,000 and up to $12,500,000 in order to avoid the unknown cost of a trial.

RMG TCPA settlement class members do not have to hire an attorney as they will be represented by Matthew P. McCue, Alexander H. Burke, Daniel J. Marovitch, Edward A. Broderick, and Anthony Paronich.  Carnival Cruise has called upon Jeffrey S. Becker to represent them while Royal Caribbean and Norwegian have hired Catherine J. MacIvor and Jeffrey Foreman.

  • April 2, 2018: Settlement fairness hearing at 9:00 AM (class members do not need to attend this hearing in order to receive a slice of the settlement pie)

  2. I received a card about this lawsuit, returned it. then received another saying they had not received my response, I then went online and resubmitted the form, have not heard anything. One site said the matter had been settled,another said wait until Feb of 2018. Which is it? or this this another fake site?

  8. Hi- I have not received an email saying anything about sending proof of my phone bill or such. I know people have. So does that disqualify me?

  9. I just got a new notice that said I need to provide proof because they feel that they got a bunch of fraudulent responses.   11. Hi I need to have the attachment for the supplemental proof resent to me. I need to send my proof via regular mail. When I tried to upload the requested information, it said it wasn’t in the right format. I already submitted my claim before the deadline,. There is no information about who to talk to to get the email for supplemental roof resent to me.

    There has been no payouts yet. they want proof of your phone number that was called. anything that shows your name along with your phone number that they made the call to. They do not want proof that they called you so you do not need to find their number. Since I used Tracfone and I only had the number for a short period of time and it was a second phone I have no bills or any records connecting me to the number. The only thing I could come up with is I still have the phone and it shows the number under the “about your phone” and it has the MEID# so I took a photo of that and a screenshot of my tracfone acct showing my name and my inactive device with the same MEID#. I just received an email a couple days ago in my spam folder telling me that what I supplied for proof was not adequate and I have until Oct 29 to submit independent verification. Whatever that means. and I was told I can not use A contact page from your cell phone that lists you as the owner of the number is not sufficient because it is not independent verification of use or ownership.
