Who is a Class Member
You are included in the Nissan Timing Chain Defect class action settlement if you “purchased or leased in California or Washington, a Class Vehicle.”
Class Vehicles include:
- 2004-2006 Nissan Altima (VQ35 engine)
- 2004-2008 Nissan Maxima
- 2004-2009 Nissan Quest
- 2005-2007 Nissan Frontier (VQ40 engine)
- 2005-2007 Nissan Pathfinder
- 2005-2007 Nissan Xterra

Settlement Class members who file a valid and timely claim can receive either partial reimbursement or a voucher towards the purchase of a new Nissan vehicle, as outlined below:
- Class members who had repairs made after the powertrain coverage under the New Vehicle Limited Warranty has expired (5 years or 60,000 miles, whichever occurs first) but at fewer than 80,001 miles, can elect:
- (a) for Nissan to reimburse 80% of the first $900 of the cost actually paid, or
- (b) a voucher in the amount of $1,500 towards the purchase of a new Nissan vehicle
- Class members who had repairs made when the vehicle has more than 80,000 miles but fewer than 100,001 miles, can elect
- (a) for Nissan to reimburse 50% of the first $900 of the cost actually paid, or
- (b) a voucher in the amount of $1,000 towards the purchase of a new Nissan vehicle
- Class members who had repairs made when the vehicle has more than 100,000 miles but not more than 120,000 miles, can elect
- (a) for Nissan to reimburse 20% of the first $900 of the cost actually paid, or
- (b) a voucher in the amount of $500 towards the purchase of a new vehicle
Proof of Purchase
- Claimants will need to provide their Unique ID number located on their mailed claim form along with supporting documentation showing the repair to the primary or secondary timing chain system and the amount paid.

Plaintiffs Kobe Falco, Joel Seguin, Alfredo Padilla, and Roberto Galvan brought this consumer class action lawsuit alleging Nissan breached drivers’ warranties by intentionally failing to disclose timing chain defects associated with certain Nissan vehicles.
Specifically, the timing chain in certain Nissan vehicles is “prone to premature failure and cannot be reasonably repaired.” Moreover, Nissan reportedly knew about the problems with their timing chains since 2003 and not only refused to disclose the problem to consumers but actively concealed its knowledge about the defective timing chains.
Since the defective Nissan timing chains are prone to prematurely fail, this can pose a serious safety issue and place drivers and passengers at risk. This includes the inability to accelerate and maintain speed and can even lead to catastrophic engine failure.
Nissan denies it acted improperly and says the case is without merit. Nevertheless, the company agreed to settle to bring closure to the litigation. Complete details about the case and settlement are provided on the Nissan Timing Chain Defect settlement website.
Class members who wish to object to or exclude themselves from the Nissan Timing Chain Defect settlement must do so by June 11, 2018.
