Who is a Class Member
Anyone who received an unsolicited call from SolarCity or on behalf of the mentioned from a subsidiary. Potential members dealt with a) at least one phone call to their cell phone or b) a minimum of two calls to during a continuous 12-month period to a number listed on any National or State “Do Not Call” Registry or Solar City’s “Do Not Call” List.
*Listed numbers must have appeared on “Do Not Call” lists a minimum 15 days prior to any calls received.
Proof of Purchase
Filers must submit their name, address and the number which received any unsolicited calls. Members must verify the reception of qualifying calls from the defendant during the defined class period.

Class members of the SolarCity TCPA class action lawsuit contend that SolarCity or those working on behalf breached the Telephone Consumer Protection Act by making unauthorized marketing calls. The defense maintains innocence and denies any wrongdoing or involvement with the phone calls. Given extreme difficult in proving liability, and the defendant’s desire to avoid ongoing litigation, the two sides have agreed to a preliminary settlement. A final hearing will be held on January 18, 2018.
The current settlement agreement calls for a settlement fund to be established to the total of $15,000,000. Regardless of the number of claims, this fund shall not exceed the predetermined amount. All funds will be distributed to satisfy approved service awards, any class notice and administrative expenses in addition to reimbursement to qualifying class members. Following any approved settlement, the plaintiffs and any involved class members yield their right to extraneous claims against SolarCity in this case.
