Who is a Class Member

The Costco Fax Advertisement class action settlement includes “all persons or entities appearing in the List of Class Members to whom Defendant Costco Wholesale Corporation sent one or more facsimiles promoting its products, services, or memberships between April 2, 2011 and April 2, 2015.”

Eligible Class Members should have received notice. Only those in the Class are eligible to receive a payment from this settlement. If you believe you should be included in the Class but did not receive a notice, please contact the Settlement Administrator.

  • $70 Costco Cash Card

Each Class Member who does not exclude themselves from this settlement will receive a $70 Costco Cash Card.  The Cash Card is redeemable at any Costco located in the United States, or online at www.costco.com.  The Cash Card has no expiration date and requires no activation.  Class Members do not have to be Costco members in order to use the Cash Card.

  • You do not need to submit a Claim Form for this settlement. Unless you exclude yourself, you will automatically receive a payout once the court approves the final settlement.

In April 2015, The Becker Law Firm filed this class action lawsuit against Costco Wholesale Corp. alleging the company violated the Telephone Consumer Protection Act by sending unsolicited fax advertisements to consumers and businesses without prior express consent to do so.

Under TCPA law, it is illegal for any person (or business) to use a fax machine, computer, or other device to send an unsolicited fax advertisement with out the prior permission of the recipient. Specifically, the Junk Fax Prevention Act of 2005 – an amendment to the TCPA, prohibits the sending of fax advertisements unless there is an established business relationship or the recipient gives prior express consent to receive the fax ads.

In this case, the plaintiff, a Missouri law firm, received a fax advertisement from Costco, which they allege was unsolicited and unwanted.

Costco denies all allegations but agreed to a settlement to avoid the risk and expense of further litigation. Complete details about the case and settlement are provided on the Costco Fax Advertisement settlement website.

Class members who wish to object to or exclude themselves from the Costco Fax Advertisement settlement must do so by October 29, 2018. Class members who wish to participate in the settlement do not need to do anything.
