Who is a Class Member

You are a member of the AeroMexico Call Recording class action lawsuit “if you are a person who called one or more of AeroMéxico’s toll-free telephone numbers during the period from June 22, 2016 through July 6, 2017, while you were physically located in California and spoke with a representative.”

Settlement Amount

  • $3,350,000.00

Estimated Award

  • $50 per call

Class members who submit a timely and valid Claim Form will receive approximately $50 per qualified call, but not more than $5,000 per qualified call, although the actual amount may be more or less than $50.

AeroMexico Call Recording Settlement Notes

In April 2018, plaintiffs Malinda Kindt and George Pappas filed this class action lawsuit against AeroMexico alleging the company violated California law by recording telephone conversations without their and other consumers’ knowledge.

California law prohibits one party to a telephone call from intentionally recording the conversation without the knowledge or consent of the other. The specific law, Penal Code 632, is violated the moment the recording is made without the consent of all parties thereto, regardless of whether it is subsequently disclosed.

In Kindt’s case, she says he called one of AeroMexico’s toll-free numbers while in California to inquire about purchasing airline tickets for flights to and from Mexico and spoke with a AeroMexico representative. During the call, the representative failed to disclose to Kindt that her phone conversation was being recorded or monitored.

AeroMexico denies any liability or wrongdoing but agreed to a settlement to avoid the uncertainty and cost of further litigation and a trial. Complete details about the case and settlement are provided on the AeroMexico Call Recording settlement website.

Class members who wish to object to or exclude themselves from the AeroMexico Call Recording settlement must do so by December 15, 2018. Class members who wish to participate in the settlement must submit a claim form on or before December 15, 2018.

  • 1/16/19: Final Hearing at 8:30 am PT* (class members do not need to attend this hearing in order to receive a slice of the settlement pie).

    i just tried submitting 3 ph numbers per claim form. Upon submitting it told me could not find server. Tried several more times to no avail. Should I send form to MN address?
