Who is a Class Member

You are included in the Pepsi Background Check class action settlement if Bottling Group LLC, Grayhawk Leasing LLC, or New Bern Transport Co. (aka Pepsi Beverages Company) “had a background check run on you from June 19, 2015 through December 1, 2016 (for applicants); from June 19, 2015 through September 4, 2017 (employees subject to DOT background checks); and from June 19, 2015 through October 2, 2017 (for all other employees).”

There are approximately 23,133 class members whose rights may have been violated.

Plaintiff Altareek Grice, a former employee of X, brought this class action lawsuit against Pepsi Beverage Company alleging PBC violated the Fair Credit Reporting Act (FCRA) by procuring consumer reports regarding employees or prospective employees without making the required appropriate stand-alone disclosure.

When applying for a job or filling out new hire paperwork, many people sign a consent for a background check to be run on them. But what many don’t know is that the FCRA mandates how employers, like Pepsi, can procure a background report. Specifically, the form a potential employee or new hire signs to consent to a background check must be a stand-alone form what a disclosure statement. This disclosure form cannot be part of any other authorization.

Pepsi denies it violated any law and maintains it’s background check disclosure forms are within FCRA law but entered into the settlement to resolve the claims. Complete details about the case and settlement are provided on the Pepsi Background Check FCRA settlement website.

Class members who wish to object to or exclude themselves from the Pepsi FCRA settlement must do so by September 4, 2018. Class members who wish to participate in the settlement must submit a claim form on or before September 4, 2018.
