Who is a Class Member

There are two proposed Classes for the Petco Employee Background Check class action settlement.

The first Class includes “everyone with respect to whom Petco procured a consumer report for employment purposes during the period from May 1, 2014 through December 31, 2015.”

The second Class includes “everyone in the First Class whom an adverse action was taken based upon a consumer report but who were not provided with a pre-adverse action notification letter.”

It is estimated that each Class Member will receive approximately $21 (approximately 37, 279 people). Adverse Action Class Members will receive an additional $150(approximately 52 people).

Petco Employee Background Check Settlement Notes

In May 2016, plaintiffs Jacklyn Feist and Angelica Zimmer filed this class action lawsuit alleging Petco violated the Fair Credit Reporting Act (FCRA) by procuring consumer reports on job applicants without providing a stand-alone background check disclosure authorization form.

In order to be compliant with FCRA law, employers must make it clear to a job applicant that they are seeking permission to conduct a background check. This needs to be done in a “clear and conspicuous” written disclosure that is separate from all the other forms in a job application packet. Additionally, employers cannot include liability waivers, legal wording, or other extraneous information.

According to the Petco Employee Background Check class action lawsuit, the form was in fine print as part of its online application and not in a separate document.

Petco denies and continues to deny that it has done anything wrong, and denies that any Class Member has been injured or suffered damages as a result of their employment application practices. Class members who wish to object to or exclude themselves from the Petco Employee Background Check settlement must do so by September 24, 2018. Class members who wish to participate in the settlement do not need to do anything.
