Who is a Class Member

The StateServ Medical of Florida Background Check Class Action Settlement includes:

“All employees and job applicants of StateServ Medical of Florida, LLC, The StateServe Companies, LLC, StateServ Medical LLC, and any of their affiliates, related companies, agents and owners (the “StateServ Entities”), who were the subject of a consumer report procured by StateServ Medical of Florida, LLC, The StateServe Companies, LLC, or StateServ Medical LLC (“Defendants”) within five years of the filing of the complaint (April 18, 2017) through the date of final judgment (scheduled for January 18, 2019).”

StateServe Medical of Florida FCRA Settlement Notes

This class action lawsuit accuses StateServ Medical of Florida of violating the Fair Credit Reporting Act or FCRA. Under the FCRA law, employers are mandated to disclose in a separate document that a consumer report or background check may be obtained.

Specifically, the complaint alleges that StateServ did not make a “clear and conspicuous” disclosure in writing that a consumer report would be obtained for employment purposes, in a document that consisted solely of the disclosure.

Class members who wish to exclude themselves or object to the settlements must do so by December 18, 2018. No action is required for Class Members who wish to participate in the StateServe settlement.
