Class members who submit a timely and valid Claim Form will receive approximately $150 per qualified call, but not more than $5,000 per qualified call, although the actual amount may be more or less than $150.

In July 2018, plaintiff Geomar Rabani filed this class action lawsuit against PF Changs China Bistro alleging the company violated California law by recording telephone conversations without his and other consumers’ knowledge.
California law prohibits one party to a telephone call from intentionally recording the conversation without the knowledge or consent of the other. The specific law, Penal Code 632, is violated the moment the recording is made without the consent of all parties thereto, regardless of whether it is subsequently disclosed.
In Rabani’s case, he says he called one of PF Changs’ toll-free numbers while in California to inquire about his PF Changs gift cards and spoke with a PF Changs representative. During the call, the representative failed to disclose to Rabani that his phone conversation was being recorded or monitored.
PF Changs denies any liability or wrongdoing but agreed to a settlement to avoid the uncertainty and cost of further litigation and a trial. Complete details about the case and settlement are provided on the PF Changs Call Recording settlement website.
Class members who wish to object to or exclude themselves from the PF Changs Call Recording settlement must do so by October 5, 2018. Class members who wish to participate in the settlement must submit a claim form on or before October 5, 2018.
