Who is a Class Member
Class members of the M3 Financial TCPA Class Action Settlement include “all persons in the United States who received a call on their cellular telephones from M3 Financial made using the Global Connect dialing platform (ATDS and/or prerecorded voice messages), and whose number was not listed in the patient or guarantor field, from May 12, 2011 through May 26, 2016, inclusive, as identified in the Class List.”

The $600K settlement will be used to pay litigation costs, plaintiff incentive awards, and settlement administration costs. The remaining amount will be distributed pro rata (equally) among eligible claimants.

In May 2015, plaintiff Elaine Mason brought this nationwide class action lawsuit against M3 Financial Services in order to stop the company’s practice of making unsolicited phone calls in violation of the Telephone Consumer Protection Act.
M3 Financial Service is a debt collector for various healthcare organizations and according to the class action lawsuit, placed a number of prerecorded unsolicited phone calls to Mason’s cell phone, even though the calls were intended for someone else. These calls, Mason states, were always made by a prerecorded message that stated:
“Hello This is not a sales all. This is a second attempt to reach June Kahn in regard to the account with M3 Financial Services. If you are that person or can deliver a message to that person please have them call 708-632-5680 tonight up until 8:30 pm or on Monday through Friday 8:00 am to 4:00 pm central standard time with reference number 1[XXXX]3. This is very serious matter and it is very important we speak with them. Once again this is a second attempt from M3 Financial Services. The phone number to call back is 708-632-5680 and your reference number is 1[XXXXX]3. Thank you for delivering this message as it is very important. Press 2 to hear this message again. Goodbye.”
Can you imagine receiving these calls over and over again for months? And for a debt that is not yours, much less for someone you don’t even know? That’s why Mason took action and filed a TCPA lawsuit against M3 Financial Services. Under the TCPA, M3 Financial should have obtained prior express consent to send these unsolicited phone calls from Mason in writing.
TCPA law is very strict in how businesses can place calls or texts to consumers’ cell phones and prohibits the use of automated telephone dialing system or prerecorded voice messages without the recipients consent. The TCPA provides, among other relief, that a plaintiff may seek statutory damages of up to $500 per violation, and that this amount may be trebled for willful violations.
M3 Financial Services agreed to settle the allegations for $600K in order to avoid further litigation. Complete details are provided in the Class Notice, which is available on the M3 Financial TCPA Settlement website.
Class members who wish to exclude themselves or object to the terms of the M3 Financial TCPA Settlement must do so by April 2, 2018. Class members who wish to participate in the settlement must submit their claim form on or before March 21, 2018.
