In June 2015, plaintiff Sheena Raffin filed this class action lawsuit against Medicredit and the Outsource Group alleging the companies violated California law by recording telephone conversations without her and other consumers’ knowledge.
California law prohibits one party to a telephone call from intentionally recording the conversation without the knowledge or consent of the other. The specific law, Penal Code 632, is violated the moment the recording is made without the consent of all parties thereto, regardless of whether it is subsequently disclosed.
In Raffin’s case, she says she was contacted multiple times by the defendants regarding an alleged debt. On numerous occasions, she reportedly told Medicredit to stop calling her. Medicredit allegedly made a recording of the call, but failed to disclose to Raffin that the call was being recorded. During the conversation, Raffin discussed personal and sensitive information including the alleged debt, the status of her pending litigation, and the nature of conversations she had with her attorney. At no time did Raffin ever provide actual or constructive consent to Medicredit to record the telephone call, according to the complaint.
Both Medicredit and the other defendants deny any wrongdoing but agreed to settle claims for $5 million to avoid the burden and cost associated with further litigation. Complete details about the case and settlement are provided on the Medicredit Phone Call Recording settlement website.
Class members who wish to object to or exclude themselves from the Medicredit Phone Call Recording settlement must do so by October 15, 2018. Class members who wish to participate in the settlement must submit a claim form on or before September 8, 2018.
