Who is a Class Member

Class members of the Graphic Packaging International Wage Settlement includes “all current and former non-exempt or hourly- paid employees of Graphic Packaging, Inc. who worked in a production position within the State of California at any time between April 8, 2011 and April 26, 2017.”

Each Class Member who timely submits a valid Claim Form will receive a pro rata share (equal) of the net settlement fund based on the number of weeks actually worked by him or her as a nonexempt or hourly-paid employee in a production position during the settlement class period (workweeks). Each Class Member’s workweeks shall be determined based on Graphic Packaging International’s records.

Graphic Packaging International Wage Settlement Notes

In this wage and hour class action lawsuit, the plaintiffs allege, among other things, that Graphic Packaging International, Inc. committed numerous violations of California labor laws. Specifically, the complaint claims that Graphic Packaging International failed to pay overtime and minimum wage, did not provide proper meal and break periods, failed to pay timely wages upon termination, failed to provide accurate and complete wage statements, did not keep required payroll records, and did not reimburse production employees for business expenses.

According to the Graphic Packaging International Wage Settlement, the company will pay a total of $4 million. This amount will be used to pay attorneys’ fees and costs upt to $1.45 million, enhancement awards to the lead plaintiffs of up to $30,000, a PAGA penalty of $50,062.50, and settlement administration costs of up to $25,000. The remaining net settlement fund will be distributed on a pro rata basis according to the number of weeks a class member worked during April 8, 2011 to April 26, 2017.

GPI denies all claims brought in this wage and hour class action lawsuit but agreed to settle to avoid further litigation. Complete details about the case and settlement are provided on the Graphic Packaging Wage settlement website.

Class members who wish to object to or exclude themselves from the Graphic Packaging International Wage & Hour settlement must do so by March 26, 2018. Class members who wish to participate in the settlement must submit a claim form on or before March 26, 2018.
