Containerboard Price-Fixing Scheme Settlement Notes
- Kleen Products LLC, et al. v. International Paper Co., et al.
- Case No. 1:10-cv-05711
- Pending in the U.S. District Court for the Northern District of Illinois, Eastern Division.
Plaintiffs in this class action lawsuit allege that International Paper, Temple-Inland, Weyerhaeuser, WestRock, Georgia-Pacific, Packaging Corporation of America, and Cascades Canada engaged in a scheme to fix the prices of containerboard products. This alleged price-fixing scheme drove up the prices of containerboard products, causing direct purchasers to pay more than they would have in a competitive market. Containerboard products include linerboard, corrugated medium, rollstock corrugated sheets and corrugated products such as displays, boxes, and containers.
Both International Paper Company, Temple Island, and Weyerhaeuser have agreed to pony up $354 million. The settlement was granted final approval on October 17, 2017, but is subject to a contingent and time-limited provision and could be reduced to $236 million. The Court granted summary judgment in favor of Georgia Pacific and the plaintiffs in this case have 30 days to appeal that decision.
Packaging Corporation of America, and Cascades Canada already reached a settlement for $17.6 million and $4.8 million, respectively. At this time, no settlement funds have been dispersed.
