Who is a Class Member

The TruStaff Travel Nurses Unpaid Wages Class Action Settlement includes “all persons who were employed by Trustaff Travel Nurses, LLC (“Trustaff”) as non-exempt, hourly temporarily-assigned employees who were provided assignments at facilities in the State of California any at time between September 13, 2016 through November 1, 2018.”

TruStaff Travel Nurses Unpaid Wages Settlement Notes

Plaintiff Jeffrey Pruitt filed this class action lawsuit against Trustaff Travel Nurses, alleging the company failed to pay overtime wages, among other violations of California labor laws.

Headquartered in Cincinnati, Ohio, TruStaff is a nationwide recruiting and staffing company for travel nurses. Travel nurses are registered nurses (RNs) or licensed practical nurses (LPNs) who travel to different locations to work. Many healthcare facilities use travel nursing agencies, such as Trustaff to fill their short-term assignments.

This is not the first time Trustaff has been accused of wage and hour violations. In May 2015, the company settled a similar California unpaid overtime class action lawsuit for $3.775 million.

Trustaff denies all allegations of the lawsuit and contends that it has fully complied with the California Labor Code and all other applicable laws. However, the company agreed to settle the case for $2 million to avoid costs associated with continued litigation.

Class members who wish to exclude themselves or object to the settlement must do so by January 29, 2019.

If you wish to dispute the information about the number of workweeks showed on your notice, you must do so by January 29, 2019. If you wish to participate in the settlement, you do not need to do anything. Your payment will be mailed to you automatically after the Court grants final approval to the settlement.
