Furniture of America Unpaid Wages Settlement Notes

Plaintiff Cesar Holguin initiated this class action lawsuit against Furniture of America, claiming the company violated state labor laws by failing to properly compensate employees for overtime, bonuses, and incentive pay wages. Additionally, Holguin alleges that he and other class members were denied proper meal and rest breaks, nor did they receive complete itemized wage statements.
Furniture of America denies it did anything wrong but agreed to settle to avoid additional litigation expenses and the inconvenience litigation would cause to its operations. The company has agreed to pay $290,000 to fully resolve the claims. This amount will provide for court costs, attorneys’ fees, administration expenses, and incentive awards. Once those have been deducted, the remainder (estimated to be $80,533.33) will go to settlement class members who do not opt-out.

Class members who wish to object to or exclude themselves from the Furniture of America unpaid wage settlement must do so by February 20, 2018. Class member who wish to dispute information in the Settlement notice, including the calculation of their individual payout, must do so by February 20, 2018. Class members who wish to receive a settlement payment do not need to do anything.
