Who is a Class Member

Class members of the J.V.C. Truck Lines California Drivers Unpaid Wages Settlement include “all California residents who have been employed as truck drivers by J.V.C. Truck Lines in California and who were paid on a per-load or per-mile or percentage-of-the-load basis from April 1, 2013 through November 16, 2017.”

If you are currently employed by J.V.C. Truck Lines, your participation in this settlement will not affect your employment as California law strictly prohibits retaliation.

Your individual share of settlement will be calculated by “dividing the total number of workweeks worked by the net settlement amount to determine a workweek value. The workweek value will be multiplied by the number of workweeks each Class Member worked” from April 1, 2013 through November 16, 2017.

JVC Truck Lines California Drivers Unpaid Wages Settlement Notes

In August 2017, plaintiff Jesus Hernandez filed this California unpaid wages class action lawsuit on behalf of all J.V.C Truck Lines drivers, claiming, among other things, that the company never paid them for non-driving tasks such as “rest breaks, pre- and post-trip inspection time, loading/unloading time, cleaning, fueling, and paperwork time”, violating California wage and hours laws.

J.V.C. Truck Lines denies all of the claims raised in this case and says that its practices are in compliance with with California wage and hour laws.

The Court granted preliminary approval of the settlement terms on January 22, 2018. The Settlement Agreement and other related documents are available on the JVC Truck Lines California Drivers Settlement website.

Class members who wish to opt out or object to the terms of the JVC Truck Lines California Drivers Settlement must do so by March 22, 2018. Class members who wish to dispute the information in their individual settlement notice must do so by March 22, 2018. Class members who wish to participate in the settlement do not need to do anything to receive a payout.
