Who is a Class Member

Class members of the Andrus Transportation Services Truck Drivers Settlement include “all California residents who have been employed by Andrus Transportation Services and who were paid on the basis of a certain percentage of the load and/or per mile basis from March 21, 2014” through February 1, 2018.

Your share of the Andrus Transportation Services Truck Drivers settlement payout will be calculated by dividing the total number of workweeks worked by the net settlement amount to determine a workweek value. The workweek value will be multiplied by the number of workweeks each Class Member worked and were paid on the basis of a certain percentage of the load and/or on a per mile basis from March 14, 2014 to February 1, 2018.

Andrus Transportation Truck Drivers Settlement Notes

In September 2016, plaintiff Robert Herman filed this wage and hour class action lawsuit on behalf of all California-based Andrus Transportation Services truck drivers, claiming the company failed to pay them properly for non-driving tasks such as rest breaks, pre- and post-trip inspection time, loading/unloading time, cleaning, fueling, and paperwork time as mandated by California wage and hour laws. The Andrus Transportation Truck Drivers class action lawsuit also raises claims that the company did not provide complete and accurate wage statements.

Andrus Transportation Services denies all of the allegations and maintains that is has fully complied with California wage and hour laws, and provided its truck drivers with the required wages, provided timely rest breaks, kept accurate payroll records, and provided accurate itemized wage statements. ATS also contends that its truck drivers were properly compensated for all non-driving activities performed.

The Court granted preliminary approval of the settlement terms on February 1, 2018. The Settlement Agreement and other related documents are available on the Andrus Transportation Truck Drivers Settlement website.

Class members who wish to opt out or object to the terms of the Andrus Transportation Services Truck Drivers Settlement must do so by April 2, 2018. Class members who wish to dispute the information in their individual settlement notice must do so by April 2, 2018. Class members who wish to participate in the settlement do not need to do anything to receive money under the settlement.
