Who is a Class Member

Class members of the Flowers Baking Company Unpaid Wages Class Action Settlement include “all current and former hourly employees of Flowers Baking Co. of Lenexa, LLC, Flowers Baking Co. of Denton, LLC, Holsum Bakery of Tolleson, LLC and Holsum Bakery, Inc. who were not covered by the terms of a Collective Bargaining Agreement at any time between September 30, 2013 and March 22, 2017, as well as all current and former hourly employees of Defendant Alpine Valley Bread Company who worked at any time between March 1, 2016 and March 31, 2017.”

Flowers Bakery Company Unpaid Wages Settlement Notes

In 2016, plaintiff Rodney Robinson filed this class action lawsuit alleging that Flowers Baking Company failed to properly pay certain employees. Specifically, Robinson claims that employees who were required to put on and take off protective clothing and gear were not paid for all hours worked, including overtime pay – in violation of the Fair Labor Standards Act (FLSA) and various state wage and hour laws.

Flowers Baking Company denies any wrongdoing and contends it has acted lawfully but agreed to the settlement to avoid further litigation costs. Under the terms of the settlement, Flowers Baking Company will pay $1.2 million to eligible Class members who submit valid and timely claim forms. It is estimated their are 872 eligible Class members.

The settlement will also cover attorneys’ fees in the amount of $400,000, litigation costs in the amount of $2,804.00, settlement administration costs, and plaintiff service awards not to exceed $10,000. These amounts have already been deducted from the $1.2 million settlement amount and will not be factored into individual settlement payouts.

Class members who wish to opt-out or object to the terms of the Flowers Baking Company Unpaid Wages Settlement must do so by February 24, 2018. Class members who wish to participate in the settlement must submit their claim form on or before February 24, 2018.
